In a recent guest post for Construction Law Musings, construction expert and thought leader, Scott Wolfe, offers insight on the often complicated usually unfair lien waver. Originally designed to be easy to use and understand, the document has "taken on a life of its own," he says.

Although 12 states regulate the forms, the documents often are difficult to follow and can cause confusion for any worker without a legal background. More trouble is encountered by those trying to use the forms where they are unregulated, he says. Despite that, Wolfe argues lien wavers are only as difficult as the users make them.

"While this issue has a lot of sensitivities, it benefits everyone in the industry to make the process fair and transparent, and all parties should work hard to find middle ground," he suggests.
