Colorado Court Reviews Doctor-Prescribed Hot Tub Ruling

On Oct. 25, the Colorado Court of Appeals overturned previous decisions denying a patient Medicaid coverage for a doctor-prescribed hot tub. The court said the state must evaluate each request for durable medical equipment on the basis of medical necessity. The Court of Appeals said a state regulation barring the use of Medicaid funds for hot tub purchases violates federal law. A doctor prescribed the hot tub to help treat his patient’s arthritis, as well as various fungal infections related to HIV. The man’s illness prevents him from using public facilities, said attorney Joel Hayes. The court then turned the case back for review by the administrative law judge who originally turned the patient down.
